Terms related to Halle Berry and Olivier Martinez’s divorce have reportedly been settled after eight years. As The Shade Room previously reported, the pair filed for divorce in 2015, citing “irreconcilable differences.”
In 2016, the actors’ divorce was reportedly finalized. However, years later, it was revealed that their final custody agreement regarding their son Maceo had not been properly filed with the court. Additionally, the ex-couple needed to tie up some “loose ends” related to child support.
According to TMZ, legal documents filed in the Los Angeles County Superior Court show that the actors have agreed to “joint legal and physical custody” of their 9-year-old son Maceo.
Additionally, the court orders the child to attend individual and family counseling, which may also include his mother and older sister Nahla, whom Berry shares with her ex-boyfriend Gabriel Aubry.
The court has reportedly ordered Berry’s current boyfriend, Van Hunt, to be prohibited from participating in the family sessions.
As for custody of the 9-year-old, it is reported that Berry will keep the child between Monday and Wednesday. His father, Olivier Martinez, will keep him from Wednesday to Friday. Additionally, both parents will abide by “variations due to school closure.”
Furthermore, the pair will also alternate custody of Maceo on weekends.
According to the outlet, the actress is ordered to pay Martinez $8,000 a month in child support. Berry will also reportedly pay “an additional 4.3 percent of all income” she receives, that is over the amount of $2 million.
In addition, Berry has also been ordered to pay for Maceo’s private school tuition, extracurricular activities, total health insurance, and “any uninsured expenses.”
According to Radar Online, the actress has reportedly voluntarily paid for the “majority” of Martinez’s legal fees.
“Halle and Olivier have acknowledged to the other that by entering into a negotiated settlement of all custody and child support issues between them, each has knowingly waived her/his right to a full evidentiary hearing on the merits with respect to those issues,” a statement from the filing reportedly reads, as obtained by Radar Online.
According to Radar Online, Berry and Martinez married in 2013. However, in 2015, the former couple revealed they filed for divorce. At the time, the actors released a joint statement, as reported by The Shade Room.
“It is with a heavy heart that we have come to the decision to divorce. We move forward with love and respect for one another and the shared focus for what is best for our son. We wish each other nothing but happiness in life, and we hope that you respect our, and most importantly our children’s privacy, as we go through this difficult period.”
As The Shade Room previously reported, Berry and Martinez’s divorce was reportedly finalized in 2016. However, in 2018, the former couple was ordered to reappear in court because their final custody agreement had not been properly filed. Then, in 2019, the court sanctioned Berry and Martinez for reportedly missing a hearing related to the proceedings.
In 2020, The Shade Room reported that Berry opted to represent herself in the court proceedings while Laura Wasser would represent Martinez.
