Halle Berry is not feeling the co-parenting relationship she has with her son’s father, Olivier Martinez. At least that’s what her recently filed petition for sole custody suggests, per PEOPLE. The actress is claiming Martinez refuses “to co-parent or communicate” in a way that centers Maceo.
Halle welcomed her 10-year-old with in October 2013, about three months after marrying Martinez. She’s also a mom to a 15-year-old daughter named Nahla from a former relationship with her boyfriend, Gabriel Aubry.

PEOPLE reports that Halle Berry entered the court petition on Friday, August 16. At that point, it had reportedly been weeks since 58-year-old Martinez allegedly failed to keep seeing their co-parenting coach.
If sole custody isn’t an option, Halle wants the court to consider giving her “tie-breaking authority to make tie-breaking decisions” about Maceo’s education, health, and therapy needs.
She claims that Martinez has been “oppositional…unmoving” regarding her concerns about their son’s “educational challenges” and behavioral concerns. Additionally, Halle Berry accuses her ex-husband of withholding his “consent for years” regarding her efforts to assist their son with resources like a suitable learning environment and educational assessment.
“Because of Respondent’s opposition to any interventions whatsoever for years and because of Respondent’s prioritizing soccer activities over Maceo’s educational and psychological well-being, Maceo’s educational and behavioral challenges worsened, and he continued to fall further behind in school,” Berry’s petition reportedly reads.
Furthermore, the mom of two implied her ex-husband has repeated private “disputes” between them to Maceo. She also claims that their son’s behavior toward her changes after “long periods of custody” with his father.
Meanwhile, Martinez’s lawyer told PEOPLE they plan to respond in court in the coming weeks.
Halle & Olivier’s Divorce & Custody Agreement Took Eight Years To Finalize
For context, the former couple filed to end their marriage in 2015 and became legally single in December 2016. However, their divorce wasn’t finalized until last August. At the time, a judge ruled that Berry had to pay Olivier Martinez $8,000 a month in child support while having shared joint legal custody.
She was also ordered to pay her ex-husband 4.3% of any income she collects over $2,000,000, per PEOPLE. Additionally, mama Halle is also financially responsible for Maceo’s private school tuition, uniforms, school supplies, and extracurricular activities. Berry also agreed to give backpay for these responsibilities to her son’s father for the 2023-2024 school year.
Earlier this month, a judge denied Halle Berry’s request to intervene in their co-parenting agreement after her ex-husband missed the coaching sessions. This reported custody petition is the latest update in her custody woes with Martinez.
